Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all offers from MyCityGuides.ch.
2. Booking, Registration and Confirmation
Guided tours can be booked via the online form or by email. The date and time will be confirmed by mail by MyCityGuides.ch, subject to the request and availability, and is binding.
We endeavour to find a guide even for last-minute bookings made just a few days in advance, but cannot guarantee this in every case. If a tour is not possible, the customer will be notified as soon as possible.
3. Costs
The costs depend on the specific offer and are stated in the description of the offer on the website. The fee will be invoiced after booking and must be paid before the guided tour. For last-minute bookings, payment is made by individual agreement with MyCityGuides.
Payment is generally made in Swiss Francs (CHF). Upon request, a conversion to Euros or US Dollars can be made. The conversion is based on the exchange rate on the date of invoicing. Any transfer and conversion fees charged by banks or payment service providers are borne by the person making the payment.
4. Cancellation and Refunds
Cancellation of a booked service must be made as soon as possible by email to the MyCityGuides contact address.
In the event of cancellation of a guided tour, an administration fee will be charged:
Up to 14 days before the tour full refund: minus a 30.- processing fee
Up to 6 days before the tour: 50% refund
1–5 days before the tour: no refund
No-show: no refund
5. Rescheduling
Rescheduling is possible up to one week before the scheduled date. A processing fee of 20 Swiss francs will be charged for this.
6. Group delays
If the group is late, your guide will wait for you for 30 minutes. Please notify MyCityGuides by phone, if possible, should you arrive late. In the event of a delay, the duration of the tour will depend on the guide’s and the group’s availability. In the event of delays, there is no entitlement to the full duration of the booked tour.
7. Special provisions for 'Book a Local'
With the 'Book a Local' offer, a person with local background and knowledge accompanies individuals or small groups for a duration agreed in advance. This is an individual guiding service. Any transport and refreshment costs incurred within the agreed time frame are not included in the price. The guide for 'Book a Local' is entitled to terminate the tour early if participants’ behaviour contravenes applicable law or if the guide feels harassed by the behaviour of participants.
8. Force majeure
If a tour cannot take place or can only be carried out to a limited extent due to force majeure (e.g. natural disasters, epidemics/pandemics, official bans), MyCityGuides is entitled to adapt, postpone or cancel the tour.
In such cases, MyCityGuides shall endeavour to find a solution that is reasonable for both parties (e.g. postponement, voucher). There is no entitlement to compensation to the extent permitted by law.
9. Data Protection
MyCityGuides complies with the provisions of the Swiss Data Protection Act when handling personal data. The information provided during registration will be treated confidentially. The data will not be passed on to third parties and will only be used for administrative purposes in connection with the booking.
10. Liability and Insurance
No liability is accepted for the theft or loss of participants’ personal belongings during a guided tour.
The provider shall only be liable for damages in the event of a breach of duty caused by wilful misconduct or gross negligence on the part of the provider or persons commissioned by the provider, insofar as an exclusion of liability is not permitted by law. No liability is accepted – to the extent permitted by law – for slight negligence, indirect or consequential damages, or damages caused by third parties.
11. Applicable law and place of jurisdiction
Swiss law applies to all legal disputes relating to the offers covered by these General Terms and Conditions. The place of jurisdiction is Basel.
